Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of thescentedsoldier.com (the "Site") and any purchase you make from The Scented Soldier ("we," "us," "our," or "TSS"). By using the Site or placing an order, you agree to be bound by these Terms and by our Privacy Policy and Return & Refund Policy, which are incorporated here by reference. If you do not agree, do not use the Site.

Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. By using the Site, you represent that you meet this requirement and that any information you provide us is accurate and current.

Products and Pricing

We describe our products — candles, wax melts, sprays, soaps, and related items — as accurately as we can, but because most items are hand-poured or hand-blended in small batches, minor variations in color, appearance, and scent strength between batches are normal and not a defect.

We reserve the right to change prices, discontinue products, or correct pricing or listing errors at any time. If we discover a pricing error after you've placed an order, we will contact you before charging you and give you the option to cancel.

We reserve the right to limit quantities, refuse, or cancel any order — including an order that appears fraudulent, violates these Terms, or that we're otherwise unable to fulfill.

Payment

All payments are processed securely through Stripe. By placing an order, you authorize us, through Stripe, to charge your chosen payment method for the full amount of your order, including applicable shipping and sales tax. All prices are listed in U.S. dollars.

Shipping and Delivery

Shipping timelines, carriers, and related policies are described in our Shipping Policy, which is part of these Terms.

Returns and Refunds

Our return and refund policy is described in our Return & Refund Policy, which is part of these Terms.

Candle and Product Safety

Our products include open-flame candles and fragranced items. For your safety: never leave a burning candle unattended; keep burning candles away from children, pets, drafts, and anything flammable; trim the wick to 1/4 inch before each burn and burn on a stable, heat-resistant surface; discontinue use once about 1/2 inch of wax remains in the container; and if you have a fragrance sensitivity or allergy, test a small amount of a wax melt or other product before broader use.

Full safety and usage instructions are included with your order where applicable. You use our products at your own risk and agree to follow all included safety instructions.

Accounts

If you create an account, you're responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately if you suspect unauthorized use of your account.

Reviews and User Content

If you submit a product review or other content to the Site, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with the Site and our marketing. You're solely responsible for what you submit, and agree it will not be false, defamatory, infringing, or otherwise unlawful. We may remove or decline to publish any submitted content at our discretion.

Intellectual Property

The Site and its content — including our name, logo, product photography, and written content — are owned by The Scented Soldier or our licensors and are protected by copyright, trademark, and other laws. You may not copy, reproduce, or use our content or trademarks without our prior written permission, except as necessary to place an order or share a link to the Site.

Prohibited Uses

You agree not to use the Site for any unlawful purpose; attempt to gain unauthorized access to the Site or its systems; scrape, harvest, or reverse-engineer any part of the Site; resell our products without our prior written authorization; or interfere with the security or proper functioning of the Site.

Third-Party Links

The Site may contain links to third-party websites. We don't control and aren't responsible for the content, products, or practices of those sites.

Disclaimer of Warranties

The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. We don't warrant that the Site will be uninterrupted, error-free, or completely secure.

Limitation of Liability

To the fullest extent permitted by law, The Scented Soldier will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our products. Our total liability for any claim relating to an order will not exceed the amount you paid for the product giving rise to the claim. Nothing in these Terms limits any liability that cannot be limited or excluded under applicable law.

Indemnification

You agree to indemnify and hold The Scented Soldier harmless from any claims, damages, or expenses, including reasonable attorneys' fees, arising from your misuse of the Site, your violation of these Terms, or your violation of any law or third-party right.

Governing Law and Disputes

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws principles. Before filing a claim against us, you agree to first contact us and attempt to resolve the dispute informally. Any dispute that can't be resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in New Jersey, and you consent to that jurisdiction and venue.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.

Changes to These Terms

We may update these Terms from time to time. Changes take effect once posted here with an updated effective date. Your continued use of the Site after a change means you accept the updated Terms.
